Terms of Service

These Terms of Service govern your access to and use of Pineprompt, the AI search visibility platform operated by Height Labs. By creating an account, or by otherwise using Pineprompt, you agree to these terms. If you do not agree, you may not use the service.
If you are entering into these terms on behalf of a company or other organization, you confirm that you have authority to bind that organization, and "you" refers to that organization.
1. Definitions
- "Height Labs", "we", "us", and "our" mean Height Labs, a general partnership (vennootschap onder firma) established in the Netherlands, which operates Pineprompt.
- "Pineprompt" or the "service" means our website, web application, REST API, and MCP server, together with the features we make available through them.
- "You" and "your" mean the person or organization that uses the service.
- "Organization" means the workspace inside Pineprompt that holds your projects and members and to which a plan is attached.
- "Member" means an individual you invite into your organization.
- "Your content" means the projects, monitors, prompts, brands, tags, and other data you create or configure in the service, and the results we capture on your behalf.
2. Accounts and organizations
To use Pineprompt you need an account. You sign in with a one-time magic link or with a Google or Microsoft account; Pineprompt does not use passwords. You are responsible for the email account and the connected sign-in methods you use to access Pineprompt, and for everything done under your account.
Your work lives inside an organization. The member who creates an organization is its owner. Owners and administrators may invite other members and set their roles, which determine what each member may see and do. You are responsible for managing your members and for their use of the service. You must give us accurate account information and keep it current.
3. The service
Pineprompt monitors how AI answer engines respond to the prompts you configure. You create monitors, each scoped to a country and a language, and Pineprompt runs your prompts against the engines you enable, then captures the answers and extracts citations, brand mentions, and sentiment.
Monitors refresh on a regular cadence, which we describe on our methodology page. We do not offer real-time monitoring, and Pineprompt does not back-fill historical results, so your data begins when a monitor is created. We may change the engines we cover and the way the service works as the AI landscape evolves.
4. Plans, billing, and payment
Pineprompt is offered on a range of plans. The plans we currently offer, the features and limits of each, and their prices are shown on our pricing page. Paid plans are billed in advance on a monthly or yearly cycle, in the currency shown at checkout.
Payment
Payments are processed by Stripe. By subscribing to a paid plan, you authorize us, through Stripe, to charge your payment method for the recurring fee and any applicable taxes at the start of each billing cycle. Any applicable VAT or other taxes are calculated and shown at checkout.
Renewal
Paid subscriptions renew automatically at the end of each cycle until you cancel. You may cancel at any time from your billing settings. When you cancel, your plan remains active until the end of the cycle you have already paid for, and it is not renewed after that.
Upgrades and downgrades
When you upgrade to a higher plan, the change takes effect immediately and we charge a prorated amount for the remainder of the current cycle. When you downgrade to a lower plan, the change takes effect at the end of your current cycle, so you keep the features you have paid for until then.
Refunds and price changes
Except where required by law, fees are non-refundable, and we do not provide refunds or credits for partial periods. We may change our prices; if we change the price of a plan you are on, we will give you notice before the change applies to your next renewal. Your statutory rights as a consumer, where they apply, are not affected by this section.
5. Acceptable use
You agree to use Pineprompt lawfully and not to misuse it. In particular, you agree not to:
- break the law or infringe anyone's rights through your use of the service;
- upload or run prompts that contain unlawful, infringing, or harmful content, or that you do not have the right to process;
- attempt to gain unauthorized access to the service, other accounts, or our systems;
- interfere with or disrupt the service, for example by overloading it or circumventing its limits or rate limits;
- resell, sublicense, or provide the service to a third party except through the organization and member features we provide;
- copy, scrape, or extract the service or its underlying software other than through the API we provide; or
- use the service to build a competing product.
You must also comply with the terms of the third-party AI engines whose answers the service captures, to the extent those terms apply to your use.
6. Your content
You keep all rights you have in your content. We do not claim ownership of it. You grant us a worldwide, non-exclusive license to host, process, transmit, and display your content, and to send your prompts to third-party AI engines, only as needed to provide and improve the service for you and to comply with the law.
You are responsible for your content and for having the rights needed to use it with the service. As explained in our Privacy Policy, your prompts are sent to third-party AI engines, so you should not include personal data or confidential information in a prompt unless you have a reason and the right to do so.
You may export or delete your content using the features we provide. When you delete content or close your organization, we delete or anonymize it as described in the Privacy Policy, subject to the retention we are legally required to keep.
7. AI answers and accuracy
The answers Pineprompt captures are generated by third-party AI engines that we do not control. These answers are non-deterministic: the same prompt can return different answers from one run to the next, and an engine's behavior can change without notice when its provider updates the model. The brand mentions and sentiment we extract are produced by analysis models and are not guaranteed to be correct.
Pineprompt is a measurement and monitoring tool. You should treat its output as signal to be reviewed, not as a guarantee of fact, and you remain responsible for the decisions you make using it.
8. Our intellectual property
The service, including its software, design, and documentation, and all intellectual property rights in it, belong to Height Labs and its licensors. Subject to these terms, we grant you a limited, non-exclusive, non-transferable right to access and use the service for your own business purposes during your subscription. We reserve all rights not expressly granted to you.
If you send us feedback or suggestions, we may use them to improve the service without any obligation to you.
9. Availability and support
We aim to keep Pineprompt available and reliable, but we do not guarantee uninterrupted access. The service may be unavailable from time to time for maintenance, updates, or reasons beyond our control, including the availability and behavior of the third-party AI engines it depends on.
We provide support by email at [email protected]. Unless we have agreed a separate written service-level agreement with you, we do not commit to a specific response time or uptime level.
10. Warranties and disclaimers
To the fullest extent permitted by law, the service is provided "as is" and "as available", without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure, that the results it produces will be accurate or complete, or that it will meet your requirements. Any statutory warranties that cannot be excluded under applicable law remain in force.
11. Limitation of liability
To the fullest extent permitted by law, Height Labs is not liable for any indirect, incidental, special, or consequential damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the service.
Our total liability for all claims arising out of or in connection with the service and these terms is limited to the amount you paid us for the service in the twelve months before the event giving rise to the claim, or one hundred euros where you have not paid us any fees in that period.
Nothing in these terms excludes or limits our liability where it cannot lawfully be excluded or limited, including liability for intent or willful recklessness.
12. Indemnification
You agree to indemnify and hold Height Labs harmless from any claims, damages, and reasonable costs that arise from your content, your use of the service in breach of these terms, or your violation of the law or the rights of a third party.
13. Term, suspension, and termination
These terms apply for as long as you use the service. You may stop using Pineprompt at any time and may close your organization from your settings.
We may suspend or terminate your access if you breach these terms, if your use poses a risk to the service or to others, or if we are required to by law. Where it is reasonable to do so, we will give you notice and a chance to put things right first. We may also discontinue the service, or a plan, with reasonable notice.
On termination, your right to use the service ends. The sections that by their nature should survive, including those on your content, intellectual property, disclaimers, liability, indemnification, and governing law, continue to apply.
14. Changes to the service and these terms
We may update these terms as the product and the law change. When we make a material change, we will update the date at the top of this page and, where appropriate, tell you by email or in the app. Your continued use of Pineprompt after a change takes effect means you accept the updated terms. If you do not accept them, you should stop using the service.
15. Governing law and disputes
These terms and any dispute arising out of or in connection with them or the service are governed by the laws of the Netherlands. Any dispute will be submitted to the competent court in the Netherlands, unless mandatory law gives you the right to bring the dispute before another court. If you are a consumer, this choice of law does not deprive you of the protection of the mandatory consumer-protection rules of the country where you live.
16. General
- Entire agreement. These terms, together with the Privacy Policy and any order you place, are the entire agreement between you and Height Labs about the service, and replace any earlier agreement on the same subject.
- Assignment. You may not transfer your rights or obligations under these terms without our consent. We may transfer ours to an affiliate or in connection with a merger, acquisition, or sale of assets.
- Severability. If a provision of these terms is found to be unenforceable, the rest remain in force.
- No waiver. If we do not enforce a provision, that is not a waiver of our right to do so later.
- Force majeure. Neither party is liable for a failure to perform caused by events beyond its reasonable control.
- Notices. We may give you notice by email or through the service. You may give us notice at the address in the next section.
